Please read these Terms of Service ("Terms") carefully before using Hear My Home ("the Service," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Hear My Home is a software platform that allows real estate professionals and property owners to create narrated audio tours for their listings, generate QR codes that link to hosted buyer-facing player pages, and track basic buyer engagement data such as scan counts and play counts.
Hear My Home is a content creation and distribution tool only. We are not a real estate brokerage, licensed agent, or party to any real estate transaction. Nothing on this platform constitutes real estate advice, a listing representation, or a guarantee of any outcome related to a property sale or rental.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding agreement.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at hello@hearmyhome.com if you suspect unauthorized access.
When you use the Service, you provide property details, descriptions, photographs, and other content ("Your Content"). You represent and warrant that:
We do not verify, endorse, or guarantee the accuracy of any listing information submitted by users. Buyers and other third parties rely on listing information at their own risk.
You agree to use the Service in full compliance with the Fair Housing Act and all applicable federal, state, and local fair housing laws. You must not use the Service to create content that discriminates against or steers buyers or renters based on race, color, national origin, religion, sex, familial status, disability, or any other protected class.
Our platform includes safeguards designed to assist with compliance, but the ultimate responsibility for lawful use of the Service rests with you. We reserve the right to remove any content that we determine, in our sole discretion, violates fair housing laws or these Terms.

Paid features are available on a per-listing or subscription basis. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.
Subscription plans renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.
Per-listing purchases are non-refundable once the audio tour has been generated.
We reserve the right to change pricing at any time. We will provide reasonable notice of any price changes before they take effect.
You retain ownership of Your Content. By submitting content to the Service, you grant Hear My Home a limited, non-exclusive, royalty-free license to host, display, and deliver Your Content as necessary to operate the Service.
The Hear My Home platform, including its software, design, brand, and generated audio templates, is owned by Hear My Home and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
Hear My Home respects the intellectual property rights of others, including real estate photographers and brokerages. If you believe content hosted on the Service infringes your copyright, send a written notice to hello@hearmyhome.com that includes:
Upon receipt of a valid notice, we will remove or disable access to the identified content and notify the agent who submitted it. The agent may submit a counter-notification if they believe the content was removed in error. We reserve the right to suspend or terminate accounts of agents who are repeat infringers.
Property player pages at /listing/[token] are publicly accessible without authentication. By publishing a listing, you acknowledge that the content will be accessible to anyone with the link or QR code. You are responsible for ensuring that all published content is accurate, lawful, and appropriate.
The Service collects basic engagement data including scan counts (number of times a QR code was accessed) and play counts (number of times audio was started). This data is associated with your account and is visible to you in your dashboard. See our Privacy Policy for full details.
The Service includes an optional buyer lead capture form displayed on listing player pages. When a buyer voluntarily submits their contact information through this form, that information is stored securely and made available to the listing agent in their dashboard.

Hear My Home is not a party to any communication between you and a buyer lead. We provide the data collection mechanism only. We are not liable for your conduct in contacting or following up with leads.
Hear My Home is a marketing and content creation tool only. We are not a licensed real estate brokerage, agent, broker, or advisor in any jurisdiction. The platform does not provide real estate advice, valuations, investment guidance, or negotiation services.
The narrated audio scripts generated by the Service are marketing materials created from information you supply. You are responsible for reviewing and approving all script content before publication. If you are a licensed real estate professional, your use of this Service is subject to the rules and regulations of your licensing authority and professional association.
Hear My Home strongly recommends that licensed agents maintain appropriate Errors & Omissions (E&O) insurance coverage that covers their use of third-party marketing tools, including this Service. We are not responsible for any professional liability arising from content you create or distribute using the platform.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any audio content generated by the Service will meet your specific requirements or expectations.
To the fullest extent permitted by law, Hear My Home shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or loss of goodwill. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Hear My Home and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, Your Content, or your violation of these Terms.
We may suspend or terminate your account at any time for violation of these Terms, illegal activity, or any other reason at our discretion. You may delete your account at any time through your account settings. Upon termination, your access to the Service will cease and your content may be deleted.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Illinois.
